Service(s): Any of our offerings, such as mobile app penetration testing.
We/Us/Our: In reference to the PolarEntry company and or team.
Party: In reference to the client or PolarEntry, depending on the context.
Service Use
By working with us, you agree to use our services only for lawful purposes and that you are in compliance with all applicable laws and regulations in your area. You confirm that:
You have the legal authority to engage with us for our services.
You will provide information that is accurate, including the necessary permissions for us to proceed with the service(s) in question.
You acknowledge that our service(s) may have an impact on the performance of your systems and you accept the inherent risks involved.
Service Engagement
Before the commencement of any service with us, we will provide you with a formal proposal, outlining the scope, timeline, and cost of our service(s). Upon agreeing on these terms, we will send a formal contract to be signed to confirm what we agreed on. In addition to this, we will require:
Written consent to carry out the agreed service(s).
Any other information that has been agreed upon for us to complete the service(s).
When starting on the agreed-upon work, we will engage in a way that minimizes disruption to your operations, though no guarantees are made that these disruptions may not occur.
Confidentiality
Our service(s) are in response to needs that are sensitive by nature. Because of this, we agree to:
Maintain confidentiality regarding any information provided by the client.
Maintain confidentiality regarding any information we gather through our service(s). This information will be provided to you in a report format, and will not be made public, unless otherwise agreed upon.
In addition to this, the client also agrees to maintain confidentiality regarding any information, tools, methodologies, or other findings provided by us during the course of the contract, unless otherwise agreed upon.
Payment
The cost of our service(s) depend on your needs; there is no set pricing. If you are in need of a quote, please reach out to us via our "Contact Us" page.
The cost of our service(s) will be outlined before any commencement. We accept various method of payment, such as, but not limited to, bank-transfers, Stripe, Wise, and various forms of cryptocurrency. Terms are as follows, unless otherwise stated:
Depending on the service, a non-refundable deposit may be required before starting the service(s).
Full payment is due upon completion of the service(s).
Any late payments may result in the suspension or discontinuation of your service(s), or additional late fees being applied.
Depending on the method of payment, additional fees may be applied to make up for any payment processor fees.
Intellectual Property
All content on www.polarentry.com, including but not limited to text, graphics, logos, and images, is the property of PolarEntry or its content suppliers, unless otherwise stated, and is protected by copyright laws. Unauthorized use of our content may violate copyright, trademark, and other laws.
Any findings, tools, or reports developed or provided by PolarEntry during the periods of the service(s) are the exclusive intellectual property of PolarEntry, unless otherwise agreed upon. The client is granted a limited, non-transferable license to utilize the reports and findings solely for internal business needs, unless otherwise agreed upon.
Limitation of Liability
PolarEntry shall not be held responsible for any direct, indirect, incidental, or exemplary damages, such as system outages, data loss, or financial setbacks, that may occur from using our service(s). Our total liability in connection with any service(s) provided will be limited to the fees paid by the client.
Idemnification
You agree to indemnify, defend, and hold harmless PolarEntry, its affiliates, officers, directors, employees, agents, licensors, and suppliers from and against all claims, losses, liabilities, expenses, damages, and costs, including reasonable attorneys' fees, resulting from any violation of these Terms or out of your use of our service(s).
Termination
Governing Law
These Terms are governed by and construed in accordance with the laws of Western Australia, without regard to its conflict of law provisions.
Amendments
We reserve the right to update or change these Terms at any time. Any changes will be posted on this page, and the effective date will be updated accordingly.
